1. Acceptance of Terms

By accessing or using QRplex (“the Service”) at qrplex.app, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

QRplex provides tools for generating, managing, and tracking QR codes, including a free QR code generator, dynamic QR codes, scan analytics, and form-building functionality. The Service is provided “as is” and may change at any time without notice.

3. Account Registration

Certain features of the Service require account registration. You agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at help@qrplex.app of any unauthorized access.

4. Acceptable Use

You agree not to use the Service to:

• Create QR codes that link to malware, phishing pages, or illegal content.
• Distribute spam, unsolicited communications, or deceptive content.
• Collect personal data from users without their informed consent.
• Infringe on intellectual property rights of third parties.
• Attempt to gain unauthorized access to our systems or infrastructure.
• Resell or sublicense the Service without written permission.
• Use the Service for any purpose that violates applicable law or regulation.

5. Intellectual Property

The QRplex name, logo, design, and codebase are the property of QRplex and protected by applicable intellectual property laws. You retain ownership of any content you upload or create using the Service. By using the Service, you grant QRplex a limited, non-exclusive license to display and process your content as necessary to provide the Service.

6. Free Tier & Paid Plans

QRplex offers a free tier with limited features. Paid plans will be introduced in a future release. We reserve the right to modify, limit, or discontinue the free tier at any time with reasonable notice. Paid subscriptions are subject to separate pricing terms that will be presented at the time of purchase.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, infrastructure issues, or circumstances beyond our control. We are not liable for any losses resulting from downtime.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, QRPLEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $10 IF YOU HAVE NOT PAID).

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting help@qrplex.app.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Ontario, Canada.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date and, where appropriate, by email. Continued use of the Service after changes constitutes acceptance of the new Terms.
